End User License Agreement

This Agreement is a legal contract between you (an individual or an organization) and Round Trip. By tapping “Start” or “I agree”, or by downloading, installing or otherwise using a Product, you confirm that:

• you are of legal age under applicable law or use the Product with the consent of your legal guardian;
• if you act on behalf of an organization, you are authorized to bind it to this Agreement;
• if you buy a paid plan, you have read the Refund Policy published on round-trip.org;
• you accept the Privacy Policy published on round-trip.org.

An individual Product may have additional terms shown in the Product itself or on its website. Where they differ from this Agreement, the additional terms apply to that Product.

Subject to your compliance with this Agreement, Round Trip grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Products on devices you own or control for personal, non-commercial purposes, unless the terms of a particular Product or plan expressly allow otherwise.

The Products are licensed, not sold. Round Trip and its licensors retain all rights in the Products, including copyrights, trademarks, trade secrets and other intellectual property rights. You agree not to remove any proprietary or copyright notices from the Products. All rights not expressly granted to you under this Agreement are reserved by Round Trip and its suppliers.

The Products are distributed through different channels: as messenger bots, as applications in app stores and as web services.

When you obtain or use a Product through a third-party platform (a messenger, an app store or another service), the terms of that platform also apply to you. Where the platform terms differ from this Agreement, the stricter terms apply to distribution through that platform. Round Trip is not responsible for the operation, availability or policies of third-party platforms.

Some features of the Products are free, others are available under paid plans. The plans, prices and billing periods are published in the Product itself, on its website and on the payment screen. The price and terms shown immediately before you confirm the payment are binding on both parties.

Automatic renewal. If a paid plan is a subscription, it renews at the end of each billing period for the same period at the then-current price until you cancel it. The charge is made to your chosen payment method on the renewal date or within a day of it.

Cancellation. You may cancel a subscription at any time and without giving a reason, in the channel where you bought it:

• a subscription bought in an app store is cancelled in that store’s subscription settings;
• a subscription paid for directly in a Product or on its website is cancelled in the Product itself or by writing to [email protected].

For the cancellation to take effect before the next charge, cancel at least 24 hours before the renewal date. Cancellation stops future charges but does not end the period already paid for: paid features remain available until it ends.

Refunds. The procedure and grounds for refunds are set out in the Refund Policy published on round-trip.org, which forms an integral part of this Agreement.

You agree not to, and not to allow others to:

• copy, modify or adapt the Products or create derivative works based on them, except as expressly permitted by this Agreement or applicable law;
• decompile or disassemble the Products or otherwise attempt to obtain their source code, except where such a restriction is not permitted by applicable law;
• rent, sell, sublicense or distribute the Products or resell their features;
• interfere with, overload or gain unauthorized access to the Products or related networks, systems and services, including by using automated means to get around the limits in place;
• use the Products to stalk, harass or otherwise invade the privacy of other people, or to collect other people’s data in bulk or covertly without their consent;
• use the Products in violation of applicable law, sanctions, the terms of third-party platforms or the rights of third parties.

The Products are a technical tool: they process and transfer files and data at your request. Round Trip does not choose what you request, does not review content before processing and does not become its owner.

You agree to use the Products only with materials you have the right to work with: your own materials, materials the rights holder has allowed you to use, or within the limits expressly permitted by law. You are responsible for how you use, store and share the files you receive.

Rights holder notices. If you believe your rights are being infringed through a Product, write to [email protected]. Tell us which material is concerned, where it is located and what confirms your rights, and leave your contact details. We will review the notice and take the measures provided for by applicable law, up to restricting access to the material and blocking the infringer.

Round Trip may release updates and fixes and may add, change or remove individual features of the Products. Updates are covered by this Agreement unless they come with separate terms.

The Products may include third-party software components, including open-source ones, which are licensed under their own terms. The terms of its license apply to each such component. Round Trip gives no warranties regarding third-party hardware or software used together with the Products.

This Agreement remains in effect for as long as you use the Products. Your rights under it end automatically if you breach its terms. Round Trip may also suspend or terminate your access if there are reasonable grounds to believe that you have breached this Agreement or are using a Product in a way that harms Round Trip, other users or third parties.

Termination of access because of your breach does not entitle you to a refund for the current billing period. If Round Trip discontinues paid features on its own initiative and without any breach on your part, the unused part of the paid period is refunded pro rata.

After termination you must stop using the Products and delete any copies of them. Sections 5, 6, 9, 10, 11, 13 and 14, as well as any payment obligations already incurred, survive termination of this Agreement.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Round Trip does not warrant that the Products will meet your expectations, operate without interruptions or errors, or that defects will be fixed within any particular time.

The Products interact with third-party platforms and data sources that operate independently of us. Their owners may change, restrict or discontinue their interfaces, formats and features at any time, and authors may change access settings or delete their materials. As a result, individual features of the Products may stop working in part or in full. Round Trip is not responsible for such changes and does not undertake to restore lost features within any time frame.

Some jurisdictions do not allow certain warranties to be excluded; in those jurisdictions these exclusions apply to the extent permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROUND TRIP, ITS AFFILIATES, EMPLOYEES, SUPPLIERS AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA AND BUSINESS INTERRUPTION, ARISING FROM THE USE OF OR INABILITY TO USE THE PRODUCTS.

THE TOTAL LIABILITY OF ROUND TRIP UNDER THIS AGREEMENT DOES NOT EXCEED THE GREATER OF: THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT IN THE TWELVE MONTHS BEFORE THE CLAIM, OR TEN US DOLLARS (USD 10).

Nothing in this section excludes or limits liability for fraud, for death or personal injury, or any other liability that cannot be excluded or limited under applicable law.

You agree to compensate Round Trip, its affiliates, employees and licensors for losses and expenses (including reasonable legal fees) arising from third-party claims connected with (a) your misuse of the Products or (b) your breach of this Agreement, applicable law or the rights of third parties.

You acknowledge that Round Trip acts as a provider of a software tool and does not control the choices or actions of individual users.

You represent that you are not located in a country subject to a comprehensive trade embargo and are not on any government list of persons to whom the supply of software is prohibited or restricted. You agree to comply with applicable export control and sanctions laws.

The parties will first try to resolve any dispute related to this Agreement through negotiation: write to [email protected] and we will do our best to settle the matter. If no agreement is reached, the dispute is referred to the competent court at the place where Round Trip is established.

This does not deprive a consumer of the right to bring a claim in the courts of their place of residence, or of the protection of the mandatory rules of their country, where they have such a right. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

Round Trip may update this Agreement. The new version is published at the same address with a new update date; where reasonably possible, we also announce material changes in the Products. By continuing to use the Products after the changes take effect, you accept the new version.

This Agreement, together with the Privacy Policy, the Refund Policy and any additional terms of individual Products, is the entire agreement between you and Round Trip regarding the Products. If any provision is held invalid, the remaining provisions stay in force. If Round Trip does not exercise a right, this is not a waiver of that right. You may not assign your rights under this Agreement without the written consent of Round Trip. In case of any discrepancy between the English version and a translation, the English version prevails.
